Deadlines Under the Texas Supreme Court’s 18th Emergency Order

On June 29, 2020, the Supreme Court of Texas issued its Eighteenth Emergency Order Regarding the COVID-19 State of Disaster.  The Court’s order does not contain any additional extensions to deadlines in attorney professional disciplinary and disability proceedings.  However, the extensions set forth in the Court’s Seventeenth Emergency Order continue to apply.  All deadlines that would otherwise expire between March 13, 2020 and July 1, 2020, remain extended until August 15, 2020.  Deadlines that expire after July 1, 2020 are not extended under current emergency orders from the Supreme Court.  Litigants may file motions for extensions of time pursuant to Rule 1.09 of the Internal Procedural Rules of the Board of Disciplinary Appeals.  Similarly, motions for extensions of time to file the Reporter’s Record may be filed under Rule 4.03(c).  Notification of a late Clerk’s Record or Reporter’s Record should be filed under Rules 4.02(c)(1)(iii) and 4.02(c)(2)(ii), respectively.  The Eighteenth Emergency Order can be found here.  Motions should be submitted to filing@txboda.org.  Please contact BODA at info@txboda.org if you have questions about deadlines.
